What Italy requires when a body is brought in

When a body comes from a country outside the 1937 Berlin Convention, permission to bring it into Italy goes through two authorities: the Italian consulate and the destination municipality (comune). Below are the requirements from Italian law and government websites, with a link next to each point.

Who authorises entry

  • To bring into Italy a body from a country that has not joined the 1937 Berlin Convention, the interested person applies to the Italian consulate. The application is accompanied by a certificate of the competent local health authority (of the country of departure) that the coffin requirements (Art. 30, DPR 285/1990) have been met, plus any other documents the Ministry of Health may require (Art. 28, DPR 285/1990). presidenza.governo.it
  • According to the Italian Ministry of Foreign Affairs: if the death occurred in a country that has not joined the 1937 Berlin Convention, the Italian consulate, before issuing the mortuary passport (passaporto mortuario), requests entry authorisation for the body or ashes from the destination municipality. esteri.it

Regional rules

Entry rules differ between regions, so we check them for the place of burial. For example, this is how one municipality describes the procedure:

  • Tuscany, Municipality of Prato: according to the municipality, when a body is brought from abroad, the Italian representation abroad checks the documents and sends the request to the competent municipality, which issues the authorisation (nulla osta). comune.prato.it

Documents and language

  • Italian Ministry of Health Circular No. 24/1993 specifies that the Italian consulate must also receive: an extract of the death record; a certificate from the health authority of the country of departure that Arts. 30 and 32 DPR 285/1990 were observed; the burial authorisation from the competent authority of that country; and a medical certificate of the cause of death. epicentro.iss.it
  • For a Ukrainian document (e.g. a civil-status record) to be used in Italy, it is apostilled in Ukraine and a sworn translation (traduzione asseverata) is obtained at the competent court in Italy; according to the Italian Embassy in Kyiv, this is equivalent to legalisation. ambkiev.esteri.it

The coffin and preparing the body

  • For transport from abroad (outside the Berlin Convention), the body is placed in a double coffin: one of metal and one of solid wooden boards. The metal box is hermetically soldered; zinc at least 0.660 mm, lead at least 1.5 mm; wooden boards at least 25 mm; an absorbent layer lies at the bottom between the two boxes (Art. 30, DPR 285/1990). presidenza.governo.it
  • For such transport, from April to September the body must receive an anti-putrefaction treatment; in other months it applies to long transports or transports starting some time after death (conditions in Art. 32). The requirement does not apply to embalmed bodies (Art. 32, DPR 285/1990). presidenza.governo.it

We prepare the coffin and the body to these requirements while still in Ukraine.

The Italian Embassy in Ukraine

On the Italian side, the key link is the Italian consulate: it is the consulate that issues the passaporto mortuario, the “mortuary passport” with which the body travels to Italy.

  • For the passaporto mortuario the applicant attends the consular office by appointment with the death certificate, a certificate from the local health authority that hygiene requirements were met, and a certificate that death occurred in an area free of infectious and endemic diseases. esteri.it, archived copy
  • The Italian Embassy in Kyiv lists repatriation of remains among the forms of consular assistance to Italian citizens, on request. ambkiev.esteri.it

The Ukrainian side

We obtain the Ukrainian permits and certificates needed to take the body out of the country.

The Ukrainian paperwork is the same for every country; it is all on the page “Repatriation of a body from Ukraine to another country”.

Who receives the deceased in Italy

We arrange the transport and hand the deceased over to the funeral home in Italy that the family chooses.

The funeral in Italy is then conducted by that funeral home. Together with the deceased, we hand over the passaporto mortuario and the other documents the body travelled with.

An urn with ashes

  • Transporting ashes from a country outside the Berlin Convention requires the usual authorisations under Arts. 28–29 DPR 285/1990, but not the hygiene precautions set for transporting bodies (Italian Ministry of Health Circular No. 24/1993). epicentro.iss.it

We can also bring an urn with ashes from Ukraine to Italy. To find out the price, use the button below.

Questions about repatriation from Ukraine to Italy

Who issues the passaporto mortuario (mortuary passport)?

For transfer to Italy the consulate issues a 'passaporto mortuario'. If the death occurred in a country not party to the 1937 Berlin Convention (Ukraine is not in the list of parties on the Italian MFA page), the consulate first requests entry authorisation for the body or ashes from the destination municipality. (esteri.it, archived copy) We gather the documents for it in advance.

What coffin is needed for transport to Italy?

A double one: a hermetically soldered metal box and a second box of solid wood. The thickness of the zinc or lead and of the boards, and the absorbent layer between the boxes, are set by law; the details are in the section above.

Does the body need special treatment for Italy?

Italian law has separate rules for bringing in a body from a country outside the Berlin Convention. From April to September an unembalmed body receives an anti-putrefaction treatment; in other months it depends on how long the journey is. We will tell you what exactly is needed in your case during our first conversation.

How can a Ukrainian document be made valid in Italy?

It is apostilled in Ukraine, and in Italy a sworn translation (traduzione asseverata) is ordered from the competent court. We will tell you in advance which documents this will require.

Can an urn with ashes be taken to Italy?

Yes, we can transport an urn as well. Ashes need the usual authorisations, but not the sanitary measures set for bodies.
