Documents after a death abroad: what to arrange in Ukraine

When the deceased is back home, the paperwork is not over yet. You will need the death certificate for the funeral, the funeral allowance, the inheritance and the bank. Here we explain in plain words which papers to keep at hand, what to do with them in Ukraine and where to go with your questions.

In brief: the papers you will need at home

  • The death certificate: either a Ukrainian one from the consul, or a foreign one with an apostille or legalisation and a certified translation into Ukrainian.
  • If the consul registered the death, you will need the consul's certificate issued at registration to apply for the funeral allowance.
  • Ask the civil registry office (DRACS) whether your case needs a separate registration of the death in Ukraine.
  • Do not put off the inheritance: the notary will tell you the procedure and the deadlines for your situation.
  • We hand over to the family, together with the deceased, the documents we obtained abroad that should stay with them.

Does the death have to be registered again in Ukraine?

This is one of the first questions families ask. The answer depends on which documents you already have.

  • The consul of Ukraine registered the death. Then you have a Ukrainian death certificate. The consul either hands it to close relatives or sends it, together with the deceased's passport, to the Ministry of Foreign Affairs of Ukraine, which passes it on to the family. There is no consular fee for the registration or for the first death certificate.
  • You only have a foreign certificate. This happens, for example, in Norway: the Norwegian authorities register the death, and the Ukrainian embassy does not register it again. In Ukraine a foreign certificate is recognised if it has an apostille or legalisation, unless an international treaty provides otherwise. Foreign documents are submitted to the civil registry offices (DRACS) together with a certified translation into Ukrainian.

Whether a separate registration in Ukraine is needed when the death has already been registered abroad, please check with the civil registry office (DRACS). They will tell you what your case requires. How this works in the country where the death occurred, we will explain during our first call.

What the law says:

  • In Ukraine a death is registered by the civil registry office (DRACS); the grounds include the medical certificate of death (form No. 106/o) or another document listed in the Rules for State Registration of Civil Status Acts in Ukraine. zakon.rada.gov.ua

Sometimes the documents take a long time to collect. If more than a year has passed since the death, the consul will still register it after checking the documents, with the note “late registration” («Реєстрація з пропуском строку»).

A foreign certificate: apostille and certified translation

Ukraine has joined the Hague Convention of 1961. Between the countries that are parties to it, the convention abolishes consular legalisation: an apostille is put on the document instead. For other countries legalisation is needed, unless an international treaty exempts the document from it.

The second condition is the translation. Documents in a foreign language are submitted to the civil registry offices together with a certified translation into Ukrainian.

What the law says:

  • In Ukraine a notary certifies the accuracy of a document translation if the notary knows the languages; otherwise a translator translates and the notary certifies the translator's signature (Art. 79 of the Law on Notaries). zakon.rada.gov.ua

A few tips that will save you time:

  • Keep the originals in one folder and make several copies.
  • Check that the document is complete and not a temporary one. In Germany, for example, you may be given a certificate of deferred registration of the death (Bescheinigung über die Zurückstellung). According to the Embassy of Ukraine in Germany, it may allow a burial in Ukraine, but it is not enough for inheritance matters. For an inheritance you will need the full death certificate.
  • If something is unclear, photograph the document and send it to us on Viber, WhatsApp or Telegram. We will tell you what the paper is and what is missing.

You will find more in the article “Death certificate abroad”.

The funeral allowance: the consul's certificate

Ukraine has a state funeral allowance. When the death occurred abroad and the consul registers it, the consul issues a certificate for the social protection authorities at the time of registration. The family applies for the allowance with this certificate.

People often forget about this certificate in the first days. We will remind you and make sure it is among the documents we hand over to the family.

For the amount of the allowance, the deadlines for applying, who can receive it and which documents are needed if the consul did not register the death, please check with the Pension Fund of Ukraine or with the social protection authority where you live. We deliberately do not give the amount here: the current rules are best heard from those who pay it.

Keep the contract, the invoices and the receipts for the transport and the funeral as well: an insurer or an employer may ask for them. Who else can cover the costs is explained in the article “Who pays for bringing a body home from abroad”.

The inheritance: why you should not wait

A notary handles the inheritance. For this you will need a complete death certificate: a Ukrainian one, or a foreign one with an apostille and a certified translation. The German certificate of deferred registration of the death, for example, is not enough for inheritance matters.

The notary will tell you the procedure and the deadlines for your situation. So it is better to go as early as you can, without waiting for everything to settle. If the person left accounts or property abroad, tell the notary straight away.

Our job is to make sure that the death certificate is already in your hands by the time you go to the notary.

What we hand over to the family together with the deceased

The documents we obtained in the country of death and at the consulate, and that should stay with the family, are handed to you together with the deceased. Depending on the country, this may be:

  • the foreign death certificate, with an apostille or legalisation and a translation into Ukrainian, if they were needed;
  • the Ukrainian death certificate, if the consul has already issued it; otherwise it will be passed on through the Ministry of Foreign Affairs of Ukraine;
  • the consul's certificate for the social protection authorities, for the funeral allowance;
  • the passport and other documents of the deceased, if the consulate returned them to the person accompanying the deceased; otherwise they are sent to the Ministry of Foreign Affairs of Ukraine;
  • the contract and the invoices for the transport.

Put everything in one folder. If anything is unclear, call us and we will tell you what each paper is for.

The funeral also needs a death certificate. If we organise the funeral anywhere in Ukraine, we take care of the papers for the cemetery, including the translation and the recognition of foreign documents. You will find more on the page “Funerals across Ukraine”.

Questions about the documents after the return

Does the death have to be registered in Ukraine a second time?

Please ask the civil registry office (DRACS) what your case requires. A foreign certificate with an apostille or legalisation and a certified translation is recognised in Ukraine, and if the consul registered the death, you already have a Ukrainian certificate.

Does a foreign certificate need to be translated?

Yes. Documents in a foreign language are submitted to the civil registry offices (DRACS) together with a certified translation into Ukrainian.

What is an apostille?

It is a special mark that certifies a document for the other countries that are parties to the Hague Convention of 1961. Ukraine has joined it. For countries outside the convention, legalisation is needed instead of an apostille, unless a treaty exempts the document from it.

Where do I get the certificate for the funeral allowance?

It is issued by the consul of Ukraine when the death is registered, for the social protection authorities. Where to take it and by when, please check with the Pension Fund of Ukraine or with the social protection authority where you live.

What is the amount of the funeral allowance?

Please check the amount and the payment procedure where you will submit the documents. That way you will get a current answer.

What do I need for an inheritance?

A complete death certificate: a Ukrainian one, or a foreign one with an apostille and a certified translation. The notary will tell you the procedure and the deadlines, so contact the notary as early as you can.

In Germany we were only given a certificate of deferred registration of the death. Is that enough?

For a burial in Ukraine it may be enough, according to the Embassy of Ukraine in Germany. For inheritance matters it is not: you will need the full death certificate.

The person died more than a year ago. Can the death still be registered?

Yes. After checking the documents, the consul of Ukraine registers such a death, with the note “late registration” («Реєстрація з пропуском строку»).

Some of the documents are missing. What should I do?

Send us a photo of what you have. We will tell you what is missing and where to get it.
