What Austria requires when a body is brought in

Entry rules differ between federal states, so we check them for the place of burial.

Who sets the rules and who carries the body

  • In Austria, the legal rules and responsible authorities for transferring a body are set by the burial laws of the individual federal states (Bundesländer). oesterreich.gv.at
  • In Austria, bodies may be transferred (within a federal state, to another state or abroad) only by authorised funeral homes. oesterreich.gv.at

If the deceased was an Austrian citizen

  • For an Austrian citizen who died abroad, the family does not file a death notification with the Standesamt as for a death in Austria; the death certificate is issued by the competent authorities of the country of death, and what remains in Austria is to organise the burial (Austrian government portal oesterreich.gv.at, section on Austrian citizens who die abroad). oesterreich.gv.at
  • If an Austrian citizen dies in Ukraine, a copy of the death certificate (if possible with an apostille and a German translation) must be sent to the Austrian Embassy in Kyiv so that the competent Austrian registry office can be informed. bmeia.gv.at

The coffin and the EU border

  • The coffin must meet legal requirements, which may differ from one Austrian federal state to another. oesterreich.gv.at
  • EU law: coffins containing a body and urns containing ashes are exempt from import duties when brought into the EU (Council Regulation (EC) No 1186/2009, Art. 113; source: the official German text from the EU Publications Office). publications.europa.eu

The Austrian Embassy in Ukraine

  • If an Austrian citizen dies in Ukraine, the Austrian Embassy in Kyiv can help with transferring the body to Austria; for this it needs the contact details of the Austrian funeral home that will receive the body or urn and carry out the burial. bmeia.gv.at

The Ukrainian side

We prepare the documents for taking the body out of Ukraine, and the apostille and German translation when they are needed.

The Ukrainian paperwork is the same for every country; it is all on the page “Repatriation of a body from Ukraine to another country”.

Who receives the deceased in Austria

We arrange the transport and hand the deceased over to the funeral home in Austria that the family chooses.

  • The transfer of a deceased person from abroad to Austria must be carried out by a funeral home in the country of death together with a funeral home in Austria (Austrian government portal oesterreich.gv.at, section on Austrian citizens who die abroad). oesterreich.gv.at

That is why we need the contact details of the funeral home in Austria you have chosen and the town where the burial will take place. We speak Ukrainian, English, Polish and German, so we will liaise with the Austrian funeral home ourselves.

An urn with ashes

We can also take an urn with ashes from Ukraine to Austria; we will give you the price on request. How and where an urn may be kept depends on the rules of the federal state. Examples from Upper Austria and Vienna:

  • Upper Austria: burying or keeping an urn outside a cemetery or urn site requires a permit from the municipality where the urn will be buried or kept. land-oberoesterreich.gv.at
  • Vienna: an urn may be kept at a private home only as an exception, on application and with the permission of the Vienna City Administration (Magistrat; Section 25a of the Vienna Burial Act). ris.bka.gv.at

Questions about repatriation from Ukraine to Austria

Are the rules the same throughout Austria?

No. Each federal state has its own burial law, so we begin by finding out exactly where the burial will take place.

Who carries the body within Austria?

Only an authorised funeral home: within a federal state, between states and abroad alike.

What needs to be done if an Austrian citizen dies in Ukraine?

The Austrian Embassy in Kyiv needs a copy of the death certificate, ideally with an apostille and a German translation, so that it can inform the Austrian registry office. We arrange the translation and the apostille.

Can an urn be kept at home in Vienna?

Only as an exception: the Vienna city administration must receive an application and grant its permission.
